1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our services.
2. Artwork Listings and Sales
- 2.1 Product Descriptions
We strive to provide accurate descriptions of the artworks available for sale. However, we do not warrant that the descriptions are complete, current, or error-free.
- 2.2 Pricing
All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes or shipping fees, which will be added at checkout.
- 2.3 Payment
Payment must be made in full at the time of purchase. We accept PayPal.
3. Shipping and Delivery
We will ship artworks to the address provided at checkout. Delivery times may vary based on location and shipping method. We are not responsible for delays caused by third-party carriers.
4. Returns and Refunds
All sales are final unless the artwork is damaged during shipping or does not match the description provided at the time of purchase. In such cases, you must notify us within 24 hours of receipt to be eligible for a return or refund.
5. Disclosures for Multiples
As of now, we do not offer prints of any artworks. For artworks produced in multiples (e.g., prints, photographs, sculptures), and sold for more than $100, we will provide the following information as required by New York Arts and Cultural Affairs Law ยง 15.01:
Artist's name
Medium and technique used
Edition size and number
Date of creation
Any other relevant details affecting value
6. Intellectual Property
All content on our website, including images, text, and logos, is the property of cobbfineart.com or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written consent.
7. Limitation of Liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the artworks and services provided. We are not liable for any damages arising from your use of our website or purchase of artworks.
8. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in New York County, New York.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of the revised Terms.
